How to locate a property in Madurai, Trichy, Coimbatore and Chennai, Tamil nadu?

If the village is identified, records of the Revenue Department pertaining to the village can be searched. These records could be in the nature of Patta, Chitta, Adangal extract, extract from Settlement “A” Register, etc. The search has to be conducted for a number of years to date back to a little more than the time that you or your predecessors-in-interest first owned the property. The holdings against the names of these persons have to be checked. It is quite possible that such persons had large holdings. All the same, information on such holdings has to be gathered to deduce a basic inference.

If you are able to have better information like Survey Number or the address, then you may be able to apply for Encumbrance Certificate. Encumbrance Certificate will typically cover the period in which the transaction may have happened. Often, information regarding boundaries of the property may be required. One has to gather these data patiently. If a street name is known, it will be helpful. If a neighbour’s name can be remembered, even this may provide a clue. Practically, any bit of record, fact, detail or paper may help.

If, after applying for Encumbrance Certificates and obtaining the same, certain transactions are disclosed in the nature of entries relating to the Survey Number or property, certified copies of such documents can be applied for and obtained. These documents may be helpful, even though, the document by itself may not be relevant or related to the property.

How to get EC for land, house property? What are the extra costs involved in buying a property

Encumberance Certificate costs in the range of Rs.450 to Rs.2000.
Rs.450 is split as Rs.250 (Actual), Rs.100 for Bribe and Rs.100 for speedy process.
This can be done for 30 years.

Also, depends on different Registrar offices and different centres.
For example, Trichy KK Nagar - 15 years Office. It is better to check in other Registrar offices, if you want to thoroughly check about the property - to make it clean.

For Legal (lawyer fees), usually it is Rs.2000.

Some of the other costs are -

Stamp paper - 8% of Guideline value.
Registration - 1% of the Guideline value.
Rs.500 per lakh in guideline value for Registrar.
Rs.1500 to to Rs.2000 for Documentation Writer.

Real estate brokerage commission charges - in Madurai, Chennai, Trichy, Coimbatore, Tamil Nadu and in india


SCHEDULE OF RATES OF COMMISSION



The Estate Agent Association of India has fixed the following uniform SCHEDULE of Rates of Commission for its members, payable by their clients on different types of transactions handled by them.

SALE / PURCHASE

Where any immovable property is transferred or agreed to be transferred by way of purchase from builder or in Resale or whether by way of admitting as a member or by way of transfer of shares in Co-operative Society or Company or other Association of persons or by way of any agreement or arrangement or in any other manner whatsoever commission at the following rates on the total consideration amount (inclusive of Loan amount) and/or deferred payment, if any, shall be paid as under :

a. Where a member acts for both the Buyer and Seller, Commission at the rate of 2 % each shall be paid by both the Buyer and Seller.
b. Where a member acts only for the Buyer or the Seller commission at the rate of 2 % shall be paid by the party for whom the member acts.
c. Where there are more than two member involved in the deal, the Buyer and Seller shall pay 2% each, which will be shared amongst the member involved in the deal as per their mutually agreed terms.

The above commission at the aforesaid rates shall, unless otherwise agreed to be paid as under:
The commission shall be paid to the member at the time of execution of an Agreement or Deed of Transfer or Agreement for sale or on the completion of the transaction i.e in case of an Agreement for sale on the full purchase prices being paid or Possession of the said property, whichever is earlier


LEASE OR LEAVE AND LICENSE

a. Commission equivalent to two months compensation/rent/license fee, shall be due and payable by the License/Lessee to the member on premises secured on the leave and license basis for first period of eleven months Thereafter additional amount equivalent to one months compensation / rent shall become due and payable to the members from the Lessee / Licenses as commission for every additional renewal period of 11 months or part thereof as the case may be.
b. Similarly Lessor/Licensor shall pay brokerage equivalent to one month rent / compensation / license fee. Thereafter additional amount equivalent to half months compensation / rent shall become due and payable to the member from the Lessor/Licensor for every additional period of 11 to 12 months or part thereof as the case may be.

All the commission shall become payable to the member by the Purchaser/Seller/Licensee/Owner, as the case may be at the time of the execution of the agreement and / or at the time of handing over or taking over the possession of the accommodation / premises whichever is earlier.

Commission/Brokerage/Agency Fee/Service Charges/Terminal charges under any name paid to the member for services rendered SHALL NOT BE REFUNDABLE UNDER ANY CIRCUMSTANCES


SERVICE TAX

Section 116 of the Finance (No. 2) Act 1998 provides for levy of Service Tax on the services rendered by Real Estate Agents and Real Estate Consultants, vide Notification No. 53/98-ST yo 58/98-ST dated 7th October 1998, this has come into effect from 16th October 1998.

Currently the Rate of Service Tax on Realty Services is 10% and there is an education Cess of 2% on the Service Tax paid.
The Client has to pay a Total of 10.2% as Service Tax on the Brokerage paid by them to the Realtors.

This Rate is applicable as on 11th February 2006 and can be revised by the Government from time to time.

Real estate Property Builders and Developers from India in Doha property show

A two-day exhibition featuring 45 property developers from major cities of India will be held at Regency Halls on Friday and Saturday, at the initiative of The Times of India Group and Mindspace Events, a events management company.
The exhibition, The Times Realty India 2011, is being held in Doha for the second year running.

“We received excellent response last year and we hope this year too it receives a similar response,” said M I Sait, CMD of Mindspace Events and Exhibitions.
Sait said they were considering to organise the show in Dubai as well as in Doha in October again. “At Dubai alone, developers vended properties worth more than Rs20bn last year; this year they are expecting higher volume in both Doha and Dubai,” he said.

Sait said the show is a opportunity to bring some of the top builders and developers at platform for “our regular clients in India and outside.”

“Our aim is to bring builders and service providers from the Indian property industry face to face with customers who are planning to buy properties in back home,” he added.

Properties starting at QR100,000 to QR4mn would be on offer at the exhibition which also features a separate Kerala pavilion.

“The decision to bring all Kerala property developers on one platform was taken owing to the enormous interest shown by Keralites living in this region to the show last year,” he said.

Nine developers from Kerala are exhibiting their properties at the Doha show. They are from Kochi, Thrissur, Guruvayoor.

Others attending the show are mainly drawn from Delhi, Gurgaon, Mumbai, Chennai, Pune, Bangalore, Hyderabad, Coimbatore, Mangalore, Goa and Ooty.
Close to 1,000 properties will be on display at the event.
The show will be held from 10am to 9pm on both days, with a one-hour break for prayers on Friday at noon.

The exhibitors will include leading organisations from the industry and leading builders, flat promoters, layout promoters, housing finance companies, resorts and clubs, interior designers, house builders and real estate agents.

Procedure to buy/sell land/house/properties in Tamil Nadu India

Owning a house is an important thing in ones life. However, one needs to be careful while buying land/house to avoid falling into legal hassles. A lot of care is needed from the beginning- right from site seeing till the registration of the land. The legal status of the land is one of the first issues that you should address before confirming a property. Don't give any advance before getting confirmation about the legal status of the property.

Before buying a land, a number of checks needs to be done to confirm that the land has a clear and marketable title. The first thing is to find out the tenure, legal right of the holder of the land in government records. The tenure or possession right could be freehold, leasehold or may be held under a government grant or 'sanad'. Freehold land is always most preferable. The seller should provide all the necessary documents to the buyer.

Title deeds

The first step is to see the title deed of the land which you are going to buy. Confirm whether the land is in the name of the seller and that the full right to sell the land lies with only him and no other person. Don't be satisfied with the Xerox copy of the title deed. Insist on seeing the Original Deed. Sometimes the seller may have taken a loan by pledging the original deed. It also needs checking whether the seller has permitted any entry/access to others through this land and whether any other fact has been suppressed/left undisclosed by the owner of the land. It is better to get the original deed examined by a lawyer. Along with the title deed, the buyer can also demand to see the previous deeds of the land available with the seller.

Tax receipt and bills

Property Taxes which are due to the government or municipality are a first charge on the property and, therefore, enquiries must next be made in government and municipal offices to ascertain whether all taxes have been paid up to date. The owner should also possess the latest tax paid receipts, which you may inspect. Enquiries should also be made in various departments of the municipality to ascertain whether any notices or requisitions relating to the property have been issued and are outstanding and not yet complied with.

While inspecting the property tax receipt, it can be noted that there are two columns in the tax receipt. Make sure that the name entered in the owner's column is correct. The second column will be for the name of the one who paid the tax. Sometime the owner may not have the tax receipt with him, in such cases, contact the village office with the survey no. of the land and confirm the original owner of the land. If you are buying a house along with the property, then the house tax receipt should also be checked. Also ensure that the electricity and water bills are up-to-date and if there any is balance payment to be made, ensure that it is made by the seller.

More than one owner

In some cases, the land will be owned by more than one people. So before registering, check if there is more than one owner, and if there is, get release certificate from the other people involved.

Buying land from NRI land owners

A person staying abroad can also sell his land in India by giving a Power of Attorney to a third person authorising him the right to sell the land on his behalf. But in such cases, the power of attorney should be witnessed and duly signed by an officer in the Indian embassy in his province. There is no legal support for Power of attorney signed by a notary public.

Agreement

Once all the matters, financial/otherwise are settled between the parties, it is better to give an advance and write an agreement. This ensures that the owner does not change his word regarding the cost as well as make a sale to someone else who offers more money. The agreement should be written in 50 Rs stamp paper. The agreement should state the actual cost, the advance amount, the time span within which the actual sale should take place and how to proceed in case of any default from either parties, to cover the loss. The agreement can be prepared by a lawyer and should be signed by both the parties and two witnesses. After signing the agreement if one of the parties make a default, the other party can take legal action against him.

Registration

The land can be registered in a sub registrar office, after preparing the title deed including all the relevant information. You could get the title deed written by a government licensed Document writer. Even lawyers can prepare the deed, but the document can only be computer printed or typed, not handwritten. Handwritten documents can be prepared by only those who hold the scribe license.

A draft should be prepared before actually writing the document in stamp paper. Make sure all the details mentioned are accurate. If there is incorrectness in the document after registering, a secondary document with the correct details has to be registered and depending on the incorrectness, the registration expenses will be repeated.

Make sure that the deed is registered within the time limit mentioned in the agreement. Original title deed, Previous deeds, Property/House Tax receipts, Torence Plan (optional) etc plus two witnesses are needed for registering the property. Torence plan is a detailed plan of the property prepared by a licensed Surveyor which will have accurate details of the measurements including width, length, borders etc. This plan is needed only in some specific areas. For land costing more than five lakhs, the seller should submit either his Pan Card or Form Number 16 during registration.

The expenses involved during registration include Stamp Duty, registration fees, Document writers/ lawyers fees etc. The stamp duty will depend on the cost of the property and varies from Municipality to Corporation to Panchayat. In Panchayat the stamp duty will be 4% of the cost of the land whereas in Municipality it is 5% and in Corporation 6%. Two percentage will be charged as the registration fees. Document writers fees also depend on the cost of the property and varies with individuals. There is a percentage prescribed by the government as Document writers fee and they cannot charge more than the prescribed limit.

Changing the title in Village office:

The whole legal procedure of buying the property will be complete only if the new owners name is added in the village office records. An application can be made along with the copy of the registered deed to the Village office to get this done.

It is advisable to measure the land before registering the land in your name. Ensure that the measurements of the plot and its borders are accurate. You can do this with the help of a recognized surveyor. This will avoid a lots of problems in the future. You could also take the Survey Sketch of the land from the Survey Department and compare for accuracy.

More than one owner

In some cases, the land will be owned by more than one people. So before registering, check if there is more than one owner, and if there is, get release certificate from the other people involved.

Buying land from NRI land owners

A person staying abroad can also sell his land in India by giving a Power of Attorney to a third person authorising him the right to sell the land on his behalf. But in such cases, the power of attorney should be witnessed and duly signed by an officer in the Indian embassy in his province. There is no legal support for Power of attorney signed by a notary public.

Agreement

Once all the matters, financial/otherwise are settled between the parties, it is better to give an advance and write an agreement. This ensures that the owner does not change his word regarding the cost as well as make a sale to someone else who offers more money. The agreement should be written in 50 Rs stamp paper. The agreement should state the actual cost, the advance amount, the time span within which the actual sale should take place and how to proceed in case of any default from either parties, to cover the loss. The agreement can be prepared by a lawyer and should be signed by both the parties and two witnesses. After signing the agreement if one of the parties make a default, the other party can take legal action against him.

Registration

The land can be registered in a sub registrar office, after preparing the title deed including all the relevant information. You could get the title deed written by a government licensed Document writer. Even lawyers can prepare the deed, but the document can only be computer printed or typed, not handwritten. Handwritten documents can be prepared by only those who hold the scribe license.

A draft should be prepared before actually writing the document in stamp paper. Make sure all the details mentioned are accurate. If there is incorrectness in the document after registering, a secondary document with the correct details has to be registered and depending on the incorrectness, the registration expenses will be repeated.

Make sure that the deed is registered within the time limit mentioned in the agreement. Original title deed, Previous deeds, Property/House Tax receipts, Torence Plan (optional) etc plus two witnesses are needed for registering the property. Torence plan is a detailed plan of the property prepared by a licensed Surveyor which will have accurate details of the measurements including width, length, borders etc. This plan is needed only in some specific areas. For land costing more than five lakhs, the seller should submit either his Pan Card or Form Number 16 during registration.

The expenses involved during registration include Stamp Duty, registration fees, Document writers/ lawyers fees etc. The stamp duty will depend on the cost of the property and varies from Municipality to Corporation to Panchayat. In Panchayat the stamp duty will be 4% of the cost of the land whereas in Municipality it is 5% and in Corporation 6%. Two percentage will be charged as the registration fees. Document writers fees also depend on the cost of the property and varies with individuals. There is a percentage prescribed by the government as Document writers fee and they cannot charge more than the prescribed limit.

Global recession hits Madurai too

There is a record of decrease in land transactions for the past couple of months in the tamil nadu state itself. Looks like there is a loss of Rs.50 crores approximately lost in revenues for Government of Tamil Nadu on land transactions.

This is a bad sign to be noted. Hopefully it is temporary and everything would come back. There is a little apprehension in everyone's mind whether market would be down for sometime or will it be back to normal!

People are holding off in investing in any assets. Instead, it is safe to keep everything in cash - may be!

I will be talking to realty consultants in Madurai today. I will get back to you all with some expert views on this.

Allotment orders to the Top IT Companies - HCL, Satyam, Sutherland, Scope, Tessolve, Honeywell etc., in Madurai IT Park

Madurai IT Park was in PAPER and DOCUMENTs so far.

Now, it is becoming reality.

Tamil Nadu Chief Minister Kalaignar M Karunanidhi had allotted lands to the top IT companies from HCL, Sathyam, Sutherland, Scope, Tessolve and Honeywell in Madurai IT Park in Vadapalanji.

Madurai is on the IT revolution right now. Karunanidhi granted allotment orders for 160 acres in Madurai, Tirunelveli, Tiruchi and in Chennai, to top 8 companies that have come forward to set up shop in IT Parks being set up by the state owned Electronics corporation of Tamil Nadu (ELCOT).

The IT companies have surely realised that they stand to gain by moving to the IT SEZs in Tier II cities, like the ones in Madurai, Tirunelveli(Nanguneri SEZs) and Tiruchi. As the STPI benefits will last only till 2010, the IT SEZs are the preferred destinations as companies can enjoy benefits for 10 more years.

International Terminal in Madurai Airport Function: A Recap

The Tamil Nadu government had given administrative sanction to acquire 614.33 acres of land to expand the Madurai airport, Chief Minister M. Karunanidhi said, laying the foundation stone for a terminal building here on Saturday.

By March 2009, we would have the first international flight from this new terminal, he added. - Bureau Report

Chief minister M Karunanidhi on Saturday April 26th 2008 laid the foundation stone for a new integrated terminal building at the Madurai airport, a facility that would handle 500 passengers at a time.

Airport officials said the integrated terminal building would be ready by March 2009. Constructed at a cost of Rs 130 crore, it would have state-of-the-art facilities and amenities, including aerobridges, flight information display system and centralised air-conditioning.

The present terminal has the capacity to handle only 200 passengers.

Karunanidhi said all airports in the state would be pieces of architectural excellence and match world class airports.

Karunanidhi also laid the foundation stones for IT parks developed by Electronics Corporation of Tamil Nadu at Ilandaikulam and Vadapalanji in Madurai.

Madurai, a tier-two city in southern Tamil Nadu, best known for its temple and jasmine flowers, is expanding on all sides, thanks to height restrictions on buildings within the city, growing wealth, increasing availability of facilities such as mini-bus services to suburbs, and anticipation of investments especially in the IT and BPO sectors.

In most parts of Chennai, apartments in new complexes cost between Rs 70 lakh to Rs 1 crore. As for adjoining suburbs, prices are in the range of Rs 40 lakh to Rs 50 lakh.

For instance, ongoing projects on the Madurai Highway are priced at Rs 45 lakh and above.

Consider the economics. To buy a flat worth Rs 50 lakh, a salaried employee would have to pay Rs 7.5 lakh upfront and an equated monthly instalment (EMI) of Rs 50,000 to service the balance Rs 42.5 lakh home loan over the next 20 years. Going by bank eligibility norms, he or she would need a salary of Rs 1 lakh per month to obtain a loan to pay such a high EMI. Obviously, those with such high salaries are few in number and on the highest rung of the corporate ladder.

It is getting tougher and tougher to buy a property in India. Normal people cannot afford a property in Madurai, Chennai and India.

There is nothing we can do, while the economy and markets takes its own course.
